Learning about your rights

Information about your rights (Article 13 of the GDPR and Section 19 of Act No. 18/2018 Coll.)

The controller's information obligation pursuant to Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and in accordance with Section 19 of Act No. 18/2018 Coll. on the Protection of Personal Data.

Dear customers, we would like to assure you that the security of your personal data and its lawful processing is of paramount importance to us. Below you will find an overview of your rights and key information.

The data subject is any natural person who is interested in purchasing goods and/or using services on our website and who becomes a party to a contractual relationship based on a purchase contract.

Purposes of processing and legal bases

• Performance of the contract (Article 6(1)(b) GDPR): order processing, delivery of goods, communication, customer account management.

• Fulfillment of legal obligations (Article 6(1)(c) GDPR): accounting and tax obligations, document retention.

• Legitimate interest (Article 6(1)(f) GDPR): protection of legal claims, IT security and website operation.

• Consent-based marketing (Article 6(1)(a) GDPR): sending offers and news if you give your consent (can be revoked at any time at haf@poshmack.com).

Your rights under GDPR

• Right of access: to obtain confirmation as to whether we are processing your data and a copy of the data.

• Right to rectification: to request the correction of inaccurate or incomplete data without undue delay.

• Right to erasure ("to be forgotten"): if one of the reasons under Article 17 GDPR applies (e.g. data is no longer necessary, withdrawal of consent, unlawful processing).

• Right to restrict processing: in cases pursuant to Article 18 GDPR (e.g. contestation of the accuracy of data, unlawful processing without a request for erasure).

• Right to portability: to receive data in a structured, commonly used and machine-readable format or to transmit it to another controller, if the legal basis is consent or a contract and the processing is carried out by automated means.

• Right to object: to processing based on legitimate interest (including profiling) and to direct marketing.

• Right to file a complaint: to the Office for Personal Data Protection of the Slovak Republic if you believe that the processing is in violation of regulations.

• Right to withdraw consent: at any time, without affecting the lawfulness of the processing before withdrawal.

How to exercise your rights

You can exercise your rights by e-mail at: haf@poshmack.com or in writing to: NEFKUS sro, Coburgova 9206/82C, 917 01 Trnava. We will respond without undue delay, no later than 1 month from receipt of the request (the period may be extended by 2 months in justified cases).

Recipients and transfers to third countries

We may disclose your data to our contractual partners within the EU (IT services, hosting, payment and courier services, accounting services) to the extent necessary. We do not transfer data to third countries outside the EU/EEA without adequate safeguards under the GDPR.

Retention period

The data is stored for the duration of the contractual relationship and after its termination for the periods set by law or necessary for the exercise of legal claims. We store data processed on the basis of consent until its withdrawal.
