INSTRUCTIONS ON THE EXERCISE OF THE CONSUMER'S RIGHT TO WITHDRAW FROM THE PURCHASE CONTRACT AND FROM THE CONTRACT FOR THE PROVISION OF DIGITAL CONTENT NOT SUPPLIED ON A TANGIBLE MEDIUM (CONCLUDED AT A DISTANCE)

I. DEFINITION OF TERMS
Consumer: "A consumer is a natural person who, in connection with a consumer contract, an obligation arising from it or a commercial practice, is not acting within the scope of his business or profession."
Trader: "A trader is a person who, in connection with a consumer contract, an obligation arising from it or in a business practice, acts within the scope of his business activity or profession." NEFKUS sro, Company ID: 52270548, Coburgova 9206/82C, 917 01 Trnava, e-mail: haf@poshmack.com.
Distance contract: "A contract between a Trader and a Consumer concluded exclusively through one or more means of distance communication without the simultaneous physical presence of the contracting parties."
Purchase Agreement: an agreement concluded between the Consumer and the Merchant, the subject of which is the purchase of goods (in particular dog tables and accessories) available on the website www.poshmack.com.
Contract for the provision of digital content: a contract concluded between the Consumer and the Trader, the subject of which is the provision of digital content, if it is on offer.

II. RIGHT TO WITHDRAW FROM THE PURCHASE CONTRACT
The consumer has the right to withdraw from the Purchase Contract without giving a reason within 14 days.
The period expires 14 days from the date of receipt of the goods by the Consumer.
When exercising the right, the Consumer informs the Retailer by an unequivocal statement (by post or e-mail) to the address: NEFKUS sro, Coburgova 9206/82C, 917 01 Trnava or e-mail: haf@poshmack.com. For this purpose, he may use this form.
The period is deemed to have been observed if the Consumer sends a notice of withdrawal to the Retailer no later than the last day of the period.
The consumer does not have the right to withdraw if the delivery involves goods enclosed in protective packaging that is not suitable for return due to health protection or hygiene reasons and the protective packaging was broken after delivery.
The consumer is obliged to return the goods or hand them over to the Retailer or a person designated by him within 14 days of withdrawal, if the Retailer does not collect the goods in person.
The consumer only bears the costs of returning the goods.
The consumer is responsible for any diminished value of the goods caused by handling beyond what is necessary to establish the properties and functionality of the goods.
The Trader shall refund to the Consumer all payments received under or in connection with the Purchase Agreement within 14 days of receipt of the notice of withdrawal; he may withhold them until the goods have been delivered or proof of dispatch has been provided.
If the Consumer has chosen a more expensive delivery method, the Merchant will not refund the difference between it and the cheapest regular delivery method.

III. RIGHT TO WITHDRAW FROM THE CONTRACT FOR THE PROVISION OF DIGITAL CONTENT
The consumer has the right to withdraw from the Contract for the Provision of Digital Content without giving a reason within 14 days of its conclusion.
The withdrawal is applied by notification delivered to the Retailer (by post or e-mail) at NEFKUS sro, Coburgova 9206/82C, 917 01 Trnava; e-mail: haf@poshmack.com.
If the digital content is to be made available before the withdrawal period has expired, the Consumer may give explicit consent; by giving consent and after the digital content has been fully provided, the Consumer loses the right to withdraw.
If the Consumer agreed to the disclosure before the expiry of the period and subsequently withdraws before the full provision has taken place, he will pay a proportional part of the price for the performance actually provided.
The Trader shall refund all payments to the Consumer within 14 days of receipt of the notice of withdrawal to the extent corresponding to the withdrawal; in the case of a more expensive delivery method, the difference shall not be refunded.
